Under the Standards and Regulations, solicitors are required to report serious breaches to the SRA; a requirement that replaces material breach. This class provides a reflective discussion of the concept of serious breach, with opportunity for delegates to debate the issues within the session.

Katie also explains the links between serious breaches and the annual practising certificate renewals process. Annual renewal is both largest information gathering exercise conducted by the SRA, and a source of regulatory action; being the driver for practising certificate and firm conditions.

We will also discuss the changes affecting Registered European Lawyers post-Brexit; cover the SRA’s latest position on renewal for freelance solicitors, and consider the latest regulatory information for in house lawyers.

This seminar is now also a book (link below) and is aimed at COLPs, COFAs, Compliance Officers, in house lawyers, and those with responsibility for SRA renewals. The course uses new examples, ideas, and advice beyond that featured in the book, as well as bringing the debate of serious breach to life with the other delegates in the room.

This is an interactive session with exercises designed to challenge and develop your ethical perspective. It is also a safe environment and you will not be expected to discuss compliance at your own firm or within your in house environment.

The class covers the following topics:

  • The concept of serious breach and the reporting requirements;
  • The general renewals process; what usually happens and information you and your firm need to provide on the renewal;
  • The SRA’s risk processes and how they will use the information you report – whether on annual renewal or as a serious breach;
  • Conditions on firm recognition and practising certificates:
    • Common conditions - how and when they occur;
    • Extra requirements within the renewals process;
    • How to manage conditions within your firm.
